Welcome to Aqaarna! These Terms of Use (Terms) govern your access to and use of the Aqaarna platform, website, and mobile application (collectively, the Service) operated by Aqaarna (we, us, or our). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
1. Acceptance of Terms
By creating an account, posting an ad, or using any feature of Aqaarna, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You must be at least 18 years old to use our Service.
2. User Accounts
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for: maintaining the security of your account and password
all activities that occur under your account
notifying us immediately of any unauthorized use
ensuring your contact information is up to date.
3. Posting Ads
Prohibited content includes fraudulent, misleading, or deceptive listings; illegal items or services; counterfeit or stolen goods; adult content or inappropriate material; spam or duplicate listings; items that violate intellectual property rights. Misleading or false information may result in ad removal and account suspension. Do not use copyrighted images without permission or images that violate our content policies.
3.1 Ad Content Guidelines
You agree to post only legitimate, accurate, and lawful ads.
3.2 Ad Accuracy
You are responsible for the accuracy of all information in your ads, including descriptions, prices, images, and contact details.
3.3 Image Guidelines
Images must be clear, relevant, and accurately represent the item or service.
4. Prohibited Activities
You agree not to use the Service for any illegal purpose or in violation of any laws
harass, abuse, or harm other users
impersonate any person or entity
interfere with or disrupt the Service or servers
attempt to gain unauthorized access to any part of the Service
use automated systems to scrape or collect data
post spam, unsolicited messages, or advertisements
violate any intellectual property rights
engage in fraudulent transactions.
5. Transactions and Payments
Aqaarna is a platform that connects buyers and sellers. We are not involved in the actual transaction between users. You acknowledge that all transactions are between you and other users
we are not responsible for the quality, safety, or legality of items listed
we do not guarantee the accuracy of listings or user information
you are responsible for verifying the legitimacy of transactions
featured ad payments are processed securely through our payment partners.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Aqaarna and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. By posting content on Aqaarna, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for the purpose of operating and promoting the Service.
7. Limitation of Liability
To the maximum extent permitted by law, Aqaarna shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities
damages arising from transactions between users
errors or omissions in ad content
unauthorized access to or use of your account
service interruptions or technical issues.
8. Termination
We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately, and we may delete your account and associated data.
9. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
10. Content Moderation and Removal
Aqaarna reserves the right to monitor, review, and moderate all content posted on the platform. We may remove, edit, or refuse to publish any content that violates these Terms or our community guidelines. We use automated systems and manual review processes to ensure content quality and compliance. Content may be removed immediately if it violates our policies, even if it has already been published. We will review appeals and may reinstate content if it complies with our Terms.

All ads and user-generated content are subject to review.

If your content is removed and you believe it was removed in error, you may contact our support team to appeal the decision.
11. User-Generated Content
You retain ownership of content you post on Aqaarna. However, by posting content, you grant Aqaarna a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content for the purpose of operating and promoting the Service. You represent and warrant that you own or have the necessary rights to post the content and that your content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights.
12. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Rawalpindi, Pakistan. If we cannot resolve the dispute within 60 days, either party may proceed with formal legal proceedings. You waive any right to participate in a class action lawsuit against Harchizz.
12.1 Dispute Resolution Process
Before filing any legal action, you agree to first contact us to attempt to resolve the dispute informally.
12.2 Class Action Waiver
You agree that any disputes will be resolved individually and not as part of a class action or consolidated proceeding.
13. Force Majeure
Aqaarna shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, internet outages, or government actions. In such cases, we will make reasonable efforts to resume service as soon as possible.
14. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.
15. Entire Agreement
These Terms, together with our Privacy Policy and other policies referenced herein, constitute the entire agreement between you and Aqaarna regarding your use of the Service. These Terms supersede all prior agreements and understandings, whether written or oral, relating to the Service.
